My ex-wife hiding my 6 year old son to unknown address & deprived his education. Her husband demanding money to see my son. A complaint is lodged at local PS. But PS did not take any action stating that child is staying with his mother.
I have contacted with state government's child welfare department. They advised to lodge FIR.
Thereafter under section 156, complaint is lodged before court to treat this complain as FIR u/s 344 IPC, 385 IPC, 506 IPC. The application is allowed.
What action will be taken by the police ?
Will police search my son & handover to me ?

क्योंकि आपने मजिस्ट्रेट के सामने आवेदन कर दिया है तो मजिस्ट्रेट द्वारा पुलिस को जांच करने के आदेश दिए जाएंगे इसका मतलब यह है कि पुलिस को एफ आई आर दर्ज करके जांच करनी पड़ेगी या एफ आई आर दर्ज कर चुकी है परंतु जांच नहीं कर रही है तो जांच को तेजी से निष्पादित करना पड़ेगा क्योंकि wrongful Confinement में रहते हुए आपके बच्चे को 10 दिन से ऊपर का समय हो गया है जो कि एक cognizable और गैर जमानती अपराध है इसलिए पुलिस निश्चित ही अब ठोस कार्रवाई करेगी

Hello,
As per query, your application is allowed. So police will lodge FIR and investigate. Police can arrest the accused person.

Court allowed to lodge FIR u/s 369 IPC. Can I say my son is kidnapped, as father is only legal guardian of present case. Since the accused takes away my son against my consent and hide him, can it be treated as kidnapping ?

Move either habeas corpus petition or section 97 crpc petition before the concerned authorities. Furthermore file a Act viii case for seeking educational and visitation right of your child.
