13-YEARS-OLD GIVES BIRTH, FIR AGAINST 'HUSBAND'

JAIPUR, 6 Mar 2009 :

A 13-year-old girl has given birth to a baby girl in Bundi district after which the police have registered a case against one Prakash, whom she claims to be her husband.

According to reports, Gudiya (13) was living with her brother in Kanwarpura village under Dabi police station of Bundi. Both of them did petty jobs to earn their livelihood. Gudiya’s father died three years ago and her mother left the children to live on their own.

A year ago, Gudiya started a relationship with one Prakash (26) and they got married. A few days back, Gudiya was admitted to hospital where she gave birth to a girl child. SHO (Dabi), Anil Vishnoi told TOI that a case of rape has been registered against Prakash for having s*xual relation with a minor.

section 375 of IPC clearly says that a man is liable for rape if he commits s*xual intercourse with a female with or without her consent if she is under 16 yrs of age but s*xual inetrcourse by a man with his own wife,the wife not being under 15 yrs. of age is not rape.

it is very shocking that this girl gave birth to a child when she herself is of such a tender age.she is not even medically fit to give birth.all this happens in the society due to poverty and lack of education.
