Yes, your wife is eligible to file a case of 498A - where she has to state that the husband had harrassed her ... the onus of proving lies with the husband

Yes.  Haalake bahut badlaav aaye hain police mein, ki jaanch bartaal karke complaint lo etc.

Par kya karein, corruption itni he ki kuch bhi karsakte hain, laal rang ka hajaar wala note dikhado, to kuch bhi likdenge, for eg, paani daalke aaye PS, aur complaint mein likh di ki ghaslite tha.. like that..

So without any proof she can file 498a.

And why she filed 125 first?

Ab kya he ki, the moment she started living away from you, she is as good as on the streets, begging, torn clothes, no food, etc.  So it is the duty of the husband to provide food, water, shelter, protection etc and prevent wife from begging on the streets, so she filed 125 so that she could suck your money [blood]

Failing which, ie you not paying her money, angered her to such an extent that she is filing 498a.

Next she might also file, DV case against you, to gain entry to the place where you live.

Now what you can do is, apply for anticipatory bail, and you can also directly file a divorce petition, without intimation [sending prior notice of RCR to come join me back] in reply to the 498a and the 125 and the forthcoming DV.

thanks for reply she is threatening me to file 498a after 125crpc abhi tak meri wife ne 498a ka case nahin lagaya hai wo mujse 2 saal se alag rah rahi hai for 498a she has to file complaint in my hometown police station please suggest me i think i m n trouble regards Subodh

if judge will order for the interim maintainance for my and form my son both.

 

can i  appeal for the same if amount is not suitable for me to deposit ? as i showed my salary  3000 pm

and i also showed the proof of my wife previous working

her experience certificate

her visiting card

matrimonial profile id  web page print

 

and the note sheet of Govt family councelling in which she refused to live in my hometown because of her pvt job.

Desertion ka case banta he, file divorce on basis of desertion.
