Accused not given chance to explain his stand

In a corruption related case, an accused was not given opportunity to explain his stand and without questioning him he was sent to judicial custody. Within 15 days of sending him to judicial custody, chargesheet was filed. Since this process is against natural justice, citing this logic can the chargesheet be quashed.

I came to know that there is a Supreme Court judgement, wherein chargesheet was quashed on similar grounds.

You can ask him to approach high court for quash proceedings.

Dear Mr. Raghavan, Thanks for your reply.  Is there any Supreme Court or any high court judgement where chargesheet was quashed on similar grounds.

Thanks for your reply Mr. Raghavan, I think you couldn't get my question right. I am asking for a similar judgement of any HC or SC wherein chargesheet has been quashed on similar grounds.
