Advamce paid to franchisee

I had paid advance 5 lakh rupees to a franchisee bu they are not refunding my money
They never mentioned verbally that adavce is non refundable and neither that thing is mentioned over there brochure
And also i havent signed any sort of agreement with that franchisee
Please suggest me how i can get my money back

When you paid advance money of Rs 500000/- to franchisee ?What was the mod of payment ? Without knowing  fact regarding above, proper reply of query is not possible.

Hello,

In absence of any documents about the payment of 500000/- it is very difficult to recover the money from another party. Broucher given by the other party may help you to recover money. Consult with a local advocate.

State the facts clearly. How you paid without any agreement or details? as pointed by the expert Sri Agarwal , what  mode  you  used for the payment  ?

When you paid? 

Better to consult a local lawyer and send a notice to refund the amount. Without proper evidence and records you are not easy to get back your money..

If you have entered into an oral agreement for taking franchise and had paid this amount by DD or cheque, now decided to cancel the same, you can very well communicate your decision of cancellation of the franchiship in writing and demand return of the amount you have given them as deposit, let them refuse to return or not comply our demand, you may file a money recovery suit on the basis of the documentary evidences in your possession.

Payment was done through rtgs transaction from bank only so i have receipt for that.

payment was done on 9th October 2019

after corona pandemic i m trying to convince them to refund money but they arent doing it now i have last option left of filing case 

and one more thing company headquarters are in mumbai and i am from rajasthan so case jurisdiction are can be my hometown or not ?

Yes the case jurisdiction can be Rajasthan.
