Advice Solicited

I am a NRI, and at the written request of the brother of my wife I advanced money by way of bank check and cash to purchase a shop to start his business in mumbai. In the written request, he clearly specified the amount he needs by check from me to purchase the shop, & the amount required in cash, and specified that he would repay the money with what ever bank interests that I am getting at that time, and that if he does not pay within 3 years, as a default, he would hand over the title of the shop ownership to me & my wife.  

The 3 years have passed, but now he has failed to return the money with the promised bank interest, and also not transfered the shop to our name.

Please advise what actions can be taken obtain the refund of our money & interest, or transfer of shop title to our name as agreed in writing before we sent the money officially by check from our NRI bank accounts.
