Dear Sir/Madam, is it mandatory for apperance of all accused during discharge petition? my lower court lawyer in TN says, am violating the court procedure by not appearing, and court has rights to question accused for framing charges.
On the other hand, my HC lawyer said, do not appear in the court for questioning till we get stay order in HighCourt. PP has not filed counter, again taken a date for filing counter which falls under greater than 90 days, my lawyer says it is the favour PP is doing to us. I am completely confused. could you please advise on the appearance during discharge petition proceedings. thanks a lot.
