Under which section of Crpc can I file an application challenging the maintainability of Crpc 125 on the grounds of desertion?

When a notice is received by you along with the petition filed by the petitioner u/s. 125 CrPC, you have to challenge the maintainability while giving answer to the petition itself. You need not quote any other Section.
