Bail in 498a

I have obtained anticipatory bail for my brother in 498a. Our lawyer is now saying that this bail has to be converted to regular bail. But my brother has not been arrested at anytime. IS it true that the Anticipatory bail in 498a has to be converted to "Regular bail", even if no arrest has taken place, and when the chargesheet has not been filed yet?

 What are the conditions stipulated in the AB obtained by you for your brother.

@advocate sastry If arrested,to be released by executing surety, to cooperate with IO, and not to tamper with witnesses.

The AB will have to be replaced with Regular  bail once the arrest takes place.  Since in the given case neither arrest has been made nor the charge sheet is filed, please ask your Advocate that the AB can continue to be valid.

Read the complete order. Bail bonds have to be furnished at the time of filing of CS or anytime before, if so stipulated in the order.

@advocate sastry thank you...you mean, should I ask my lawyer whether we can wait till CS is filed, or should I order him to get regular bail ONLY after CS is filed? :)

Not need to worry, fulfill the condition of the court order if there is no time specific mentioned in AB order no need to get any regular bail.

Dear Dino you need to furnish surety to IO at the time you submit to in vestigation this will ensure that police will not arrest even if they want. then attend investigations freely as and when you are called by IO . The day your charge sheet will be filed you again will have to furnish surety to court. now onwards you will be in judicial custody and will be required to attend court on hearing dates. no further role of police after this point. regards ASHOK
