Breach of contract

I had contract with my labour and they took advance of Rs. 50000/- but after starting work they ran away and without deducting advance from the amount of work they have completed. I have written contract.

Can I file FIR u/s 420 against them for duping me?

If the contract provides for any action under criminal in default , then you can go for FIR, otherwise it is simplly a civil dispute where you have agreed upon terms and conditions. If the aprty defaults you can take action only under contract terms.

Contact an advocate locally as he is better to show you a way to recover money if you have a copy of their AADHAR or Voter card.

Both the civil as well as criminal remedy is available to you.

It is better to consult and engage a local prudent lawyer for proper analyses of facts/ documents, professional advise and necessary proceeding.
