Builder resorting to covid as excuse for delayed possession

I had booked a flat in Dec 2016. The agreement to sale was made in Apr 2018 and the date of possession mentioned on the agreement was 30th Sep 2021.

I got the possession on 20th Oct 2023. When I approached to RERA for delayed possession, the builder has given covid extensions as reason for delay. He says the date of possession now is 30th Sep 2023 due to the RERA extensions and the 1 year extension that a builder is entitled to by RERA.

Is there any way to counter this arguement / how should I proceed further in this case.?

You may have to ascertain if there was any extension granted by RERA besides the covid period relaxation.

The builder has given his side explanation but it is not necessary that you have to accept it, you can refuse to accept his explanation and insist on penalty as per law
