I had purchaged 2BR flat ( for 21Lacs including reg+all taxes) in Pune from class-C builder in year 2010 and sold the same flat to third party in Jun 2012 as I have to move to Bangalore.Agreement says that I have to pay Tax whenever govt demands Tax for this property but I have negotiated the price Rs.21Lacs which includes Tax before agreement.Hence builder allowed me to sale the flat without NOC in jun 2012.This Flat is now owned by new owner and he is enjoying since Jun 2012.Last month (Nov 2013) suddenely I have received demand letter from builder to pay tax Rs.1.1Lacs towards my flat which I do not own it now.Can you please advise on following points:
1) Am I legally bound to pay Tax amount after sale of flat? ( Agreement does not say anything I have to pay after sale of flat)
2) Can I say no to him through legal notice.
3) He is threating me pay the tax otherwise he will send his mans to home
kindly help me to protect from him through legal way.
