THE INDIAN SUCCESSION ACT, 1925;36-40

Supreme Court of India

Mrs. Mary Roy Etc. Etc vs State Of Kerala & Ors on 24 February, 1986

Equivalent citations: 1986 AIR 1011, 1986 SCR (1) 371

Author: P Bhagwati

Bench: Bhagwati, P.N. (Cj)

The execution petition was ordered in 2010.

You have posted another query on marital discord.

The property of the wife may devolve upon her legal heirs if husband is already divorced.

If the wife has deceased then her legal heirs as on date on her death can claim her share from her inherited estate.

You may take help of elders of your family, competent and experienced well wishers, seasoned PIP’s, helpgroups, community leaders, NGO’s, experienced colleagues, associations, etc and  find a very able LOCAL counsel specializing in concerned filed of law e.g; Family/Succession/Civil matters as in your case, and well versed with LOCAL applicable rules, precedence, latest judgments etc …. and worth his/her salt, can advise you and even help you.

Online discussions are not substitute to in person discussions with a very able counsel of unshakable repute and integrity specializing in concerned field of law.

There are such very able counsels at each location.

Check for such counsels at LOCAL e.g;, Family/Civil courts, HC, SC …

The learned scholars of your personl faith/sect/sub-sect can also update you.You may ask in church where you offer prayers and get inputs.

You can also try at FREE Legal Aid center that is usually in LOCAL courts complex.
