CHANNI MALIK (Colonel)     14 October 2016

Care giver

My mother had broken her hip bone and needs an attendant/nurse. There was a girl aged 27 years who had come often to look her up. Now she is willing to move permanently to look after her. She has made up her mind to run away from her home because she finds the love & care of mother very soothing and comforting. Can she leave her parents of her own will as she is 27 years. If yes would it be prudent to intimate the local police thana/cowki that she is leaving on her own and no one should come chasing behind her. As also file an application in the nearby police chowki/thana that she has come on her own. This will prevent her parents to come and forcefully take her back. Would the above procedure correct to prevent any subsequent legal complications

Kumar Doab Yes it a supplementary to an earlier query. What is really essential to do to 1 a smooth exit from her parent obviously against their volition. 2 prevent police not giving the parents any assistance to chase her down. No lodgingvof FUR etc because she is 27 and wishes to move on her own volition. Any steps or procedure to avoid police & legal assistance. My mother is alone and hence needs this nursing attendant.

Sh. Channi Malik,

She being major, can opt the living style she wants to pursue.  But as she is apprehending that her parents may lodge criminal complaint in police station, she may file a letter in the concerned police station and get it diarised and keep a copy of that letter with her, in which clearly she has to show where she is residing.  This letter will preempt any attempts to be made against her by her parents.

Let your counsel draft an agreement to the effect and sign it with the concerned party.
