Caretaker Landlord Dispute

Dear Legal Fraternity,

The mother of the lady used to live in her self owned property. The mother of the lady expired in 2012 and left a registered will for her daughter. As the caretaker of the property the lady allowed them to stay for these years with a rental amount of Rs. 3000/- which was verbal and was created in good faith as they took care of her mother.

They made payment till end of 2017. And when lady demanded to vacate from the premises they said, they are looking out for another property but they didn't vacate. In December 2018 lady made a complaint in the nearby police station that the caretaker is not vacating the property.

After that he paid the rental amount but continued to stay for little longer as he said where he will go. In July 2019 lady made a complaint in nearby chowki and take them to the chowki incharge and made a letter in which the caretaker said that he will vacate the property after 15 days.

As he said that he would vacate but he said that some close relative has expired so he won't be able to vacate at this point of time and demanded 6 months time period to vacate. And then lockdown takes place and he is not coming to clear the dues. And has also put his necessary home appliances inside the premises.


Now what legal action lady can take against those caretaker to aquire the property.
