Cghs flat ownership after death

Hi Everyone,

My father has a flat in Coop. Group Housing Society in Delhi. He passed away leaving behind my mother, me and brothers. Mother is already a nominee in society register.

What's the process to get the flat ownership/share transferred in her name ? Few members in society MC are asking for 'Succession certificate' or 'Legal Heir Certificate'. Is it necessary ?

PS : There is no will made by father.

Death certificate has to be produced to the society secretary with application to change the name on to the nominee name

it appears that the office bearers of the society do not know the provisions relating to nomination. In case one is required to obtain a successession certificate then what is the use of the nomination in records.

Since your mother is a nominee to your deceased father, ask her to move an application to transfer the shares of her husband in the society on her name enclosing the death certificate, the succession certificate or legal heirship certificate is not required.  If the office bearers of the society do not respond properly or cooperate, issue them with a legal notice demanding your requirement and ask them to oblige.
