Firstly I thank everyone in this forum for contributing with valuable information.
I have a similar incident that happened back in 2010. The story goes like this. - Unfortunately due to some unavoidable circumstances / reasons, I was deported from the UAE, and couldn't fulfill my promise to the bank of repaying my personal loan, which I was paying till the time I had a job, and till the time I was in the country.In fact, I left a good sum in my bank account, so that as long as possible, I could fulfill my payments to the bank.
Now its been 4 years since this incident, has happened, and I am living here in India, working very hard to re-build my life back. But since 2 weeks, I have been getting calls on a daily basis from a third party agency in Dubai, who have branches in India, .The agency only knows my total outstanding amount, and does not acknowledge the payments that were made. They are looking at recovering the full amount (Principal + Interest), and are threatening me that they will take legal action against me in India.
I have been co-operating with them, and have been asking them to look into my account, and see what has been paid, and how much more needs to be paid, so that we both can mutually arrive at a negotiated amount and work towards closure of this issue. But they are not willing to share any documents, and only prefer talking over the phone. They just want an email from me stating the amount I am willing to pay. So I sent an email stating the amount that has already been paid, and that I would not be able to afford to pay up as per their demands, and I am keen to negotiate.
I had also sent one of my trusted sources to the bank, and he was only allowed to meet 2 people, and no one else. According to my sources, the bank has not yet bounced my cheque. Its been 4 years now since I have defaulted on my payments. I owe them close to 200,000 (according to them)
i would like to know, how much of a legal influence does the bank, or the bank's agent have here in India?
Am I liable to be tried in India for a financial crime made in the UAE?
Can I file a complaint against the local collection agency if they continue to harass me in India?
Can I offer them a one time settlement figure and tell them to take it or leave it?
I would not like to be dragged into a case, but prefer to mutually settle it with the bank. And if I fail to settle it, what are the risks involved?
This is a local bank based in the UAE, and has presence only in GCC.
