Cheque bouncing cases

Hello Sir,


I am seeking your legal advices. A guy took 5 lks 4m me  by lying me that his father is ill. I took Personal loan and Transfered to his account in Dec 2013. He paid me a cheque of 4lkh in March 2014 which got bounced. And then he said he is trying to pay me back in somedays.. after so many chase he again gave a cheque on Dec 2014 which again got bounced.

 

Now i want to take legal action aginst him.

On Dec 2014, he deposited the cheque in ICICI bank, Odisha,  where as i have account in ICICI bank, Pune.

His cheque is from IOB, Bangalore.

So now  where i have file case against him . Going Bangalore is kind difficult.

Pls pls guide me, as i dont want to let him go like this, if i left him he will make many others life hell , the way he had done mine from last 1 yr.

you have to file bangalore. accused bank jurisdiction only comes to cause of action.

Dear Sagar, your case has become very weak rather would say can not be proceeded under under Negotiable Instrument Act. You are trapped in conspiracy, as cause of action survived until 90 days from March 2014. Cheque issued in Dec 2014 may attract charge u/s 138.

Any suggestion improvement on my views that present holder can not file complaint on Dec 14 cheque.
