Divorce by mutual consent for Christians in India is covered under the Divorce Act, 1869 under section 10A there is provision of dissolution of marriage my mutual consent. The Christian Marriage Act. 1872 provides for Christian marriages only not for its dissolution.

If both spouses feel that marriage has failed and cannot be revived and if both agree to end the troubled wedlock then they may approach a very able Senior LOCAL counsel of unshakable repute and integrity specializing in family/civil matters and well versed with latest citations, LOCAL applicable rules/laws/ … and having successful track record…. and worth his/her salt…..and show the case related docs, inputs etc etc for a considered opinion…. And to draft the MoU and further so as to protect the long term interest of both spouses (or yours or your client’s) so that as to avoid foul play and to effectively handle the foul play if any.

You may have to approach jurisdictional court for divorce by mutual consent.

The separation period for Christians and compared to other faiths was contested and place before Apex Court.....
