Chsl elections

Ours is  co-operative housing society in Mumbai having commercial as well as residential wings. Members from both wings are part of the Managing Committee in which residential side has 7 members and commercial side has 4 members in the Managing Committee.

Our residential side society secretary has resigned and his resignation has been accepted by the Chairman.

Also no election has been held in our society since last 7-8 years. Since most of the members in the current managing committee of Residential side are now senior citizens and cannot work or take decisions we have asked the Chairman as well as the resigned acting secretary to declare elections so that a new committee is formed and new office bearers who can work as well as take faster decisions can come into action.

But the resigned acting secretary is saying that he will not call AGM and do the election process with a appointed Presiding officer proposed by the residential side members to conduct elections to form a new committee. If we do not accept his decision he will call the Administratior.

Can you pls let us know how do we handle this situation so that valid and safe elections are conducted in our society without any issue of election results being cancelled or nullified by the commercial side of the society.

You can submit an application to the deputy registrar requesting to conduct election to association as per law as the term of current office bearers has already expired and they don't show any interest to conduct election for many years. 

The registrar will intervene to administer the association until the next office bearers take over.
