co-op society no general body present since 17 years

Page no : 2

Dr. MPS RAMANI Ph.D.[Tech.] (Scientist/Engineer)     17 February 2022

Society or no society, you are a body of individuals with common interest. If all of you agree and no one objects things can be done. But in due course some thing can happen such as you have not taken some statutory body's approval, as it happened in the case Campa Cola or some external body or individual is hurt because of your action. If you personally do not agree it cannot be said that all have agreed. Even if you also agree, when you redevelop you will be creating more living space and inducting more inviduals and the expanded body of individuals will have to manage their affairs. Even during redevelopment there must be a body representing members to deal with external agencies like the builder, contractors, municipality, State and Central Governments etc. etc. If no such Society with management responsibilities is available, some of the external agencies and  evan some of the individuals in the existing body of individuals will take you for a ride and finally land you in an unenviable situation. Redevelopment is a physically and legally complex matter and you need an expert lawyer experienced in redevelopment to advise you. If there is no Society, who will appoint the lawyer?
