Question is prima facie framed wrong . For criminal matter criminal procedure code is applicable for civil matter civil.procedure code is applicable. You can not introduce provision of CPC in criminal procedure . General rule to condone delay if any is to convince court indeed there was real situation by which person could not file appeal. Some cases 1 week delay is not condone only because satisfactory explanation is not given . On the other hand some matter months delay is condone because they could give satisfactory reasoning to hon. Court. Looking at type of question which is framed I would suggest better take personal opinion of criminal lawyer showing brief.
