Sale of expired commodities/ packed eatables comes under the following acts:
Under Rule 5 of the Packaged Commodities (Regulation) Order, 1975, the sale of packaged commodities without details such as date of manufacturing, maximum retail price, producer's name, and address is banned.
If any trader or retailer failed to remove and destroy the expired products from their godown or is indulging in selling the expired goods, severe action would be taken under Section 273 of the Indian Penal Code and Section 7 of the Prevention of Food Adulteration Act 1954 against such dealers.
Expired commodities are harmful/poisonous for the human body in many ways.
Section 273 of the Indian penal code talks about the sale of noxious food or drink. It states that Whoever sells, or offers or exposes for sale, as food or drink, any article which has been rendered or has become noxious, or is in a state unfit for food or drink, knowing or having reason to believe that the same is noxious as food or drink, shall be punished with imprisonment of either descripttion for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both.
