498A a pure harrassment & extortion tool ??

A recen case in investigation...

The girl filed a complaint at her father's place a rural area 350kms from her husband's & matrimonial palce against the husband's family.

The names of the husband's blind mother, his sister who works in another city & is hardly home once in a month, his uncle ,aunt who do not stay with the husband as well as his uncle's married daughter & her husband were also included alongwith the husband in the filed complaint.The reason given by the girl's father was that all these names were included because they did not meet the girl on regular basis.

It has created a tremendous tension within the husband's family as he has to travel the long distance for investigation every 10 days with his mother or uncle,compounded with the estranged realtions with his uncle.It is affecting his job as it demands him to travel throughout the country & at times abroad.

The girl's family has demanded 30 lacs & the husband's residential flat to withdraw the comlaint.The husband is a middle class person living in a metro & tried to give in his best for the sake of his mother & other relatives but to no avail.The wife is insisting on divorce & the money & flat in lumpsum.

Now he is left with no alternative than to face the court.

Can anybody advise the right direction for action to avoid court & save his job as well as reduce stress to his mother?

Move an application under section 205 Crpc for exemption of your mother, uncle. move ur application separately

I wouldn't be surprised at the list of persons included in the complaint when there had been a precursor to this incident when a two-month old baby itself got figured in a FIR seeded by a 498a case.
