i am defending a secretary of society registered under societies reg. act 1860 in a complaint u/s 138 N I Act. case is fixed for COC and my client is pressing to file revision against the order of cognigence. he had signed the cheque which has been isssued to pay a bill of goods to the complainant. he has resigned from the post prior to issuing cheque but the cheque bears his signature. Can i do somthind on this prior stage of case or wait for my defence. notice has been issued to him not to society and the bill is on the name of society.
