JUDGMENT
Dr. MUKUNDAKAM SHARMA, J.
Inspecting Judge found that sub-ordinate Judge in Garhwa, Jharkhand did not use to prepare judgments on his own, rather he used to get it prepared through some body else before delivering the judgments.
Consequently, the High Court recommended the removal of the appellant from service. Subsequent to that, the Governor decided to invoke the provisions of Article 311(2) (b) of the Constitution of India as holding of enquiry may lead to question of the validity of several judgments delivered by the appellant.

That you Tmt.R. Kalarani, Civil Judge (Junior Division)/J.M.F.C. now under suspension, while functioning as Judicial Magistrate No.I, Dindigul during the course of trial in C.C.No.97/00 on the file of the said court, contacted Thiru B.V.R. Marimuthu, the father of the complainant in C.C.No.97/2000 and one of the witnesses in the said case, to come to your residence; that when he came to your residence on 1.1.2001 at 10.00 a.m. you demanded from him a sum of Rs.2,00,000/- for convicting the accused; that when he refused to the demanded amount, you on 9.1.2001 acquitted all the accused in the said CC as he did not pay the demand amount thus committed the acts of corruption and corrupt practices, abuse of power, misuse of power and conduct unbecoming of a government servant and thereby rendered yourself liable to be punished under the Tamil Nadu Civil Services (Discipline and Appeal) Rules.

Based on the complaint, dated 19.4.2005, sent by one T.Chandran of Tirunelveli to the Registry of the High Court, to the effect that the petitioner, while working as I Additional Sub Judge, Tirunelveli had some intimacy with Tmt.Jayanthi, Head Clerk, Fast Track Court No.I, Tirunelveli, thus facilitating her to collect money from the parties in respect of the proceedings pending before the petitioner assuring favourable judgments, a discreet enquiry was conducted by the Registrar (Vigilance) High Court, Madras against the petitioner, then I Additional Sub Judge, Tirunelveli and now a District Judge, working as Sessions Judge, Mahila Court, Chengalpattu and others.

NEW DELHI: Supreme Court on Thursday sounded the grim warning that the criminal justice system had been subverted, with witnesses being manipulated and trials being hijacked with judges and lawyers remaining "handicapped witnesses".
Making the chilling observation, which to many only confirmed the widely held perception of the erosion of the system, a Bench comprising Justices B N Agrawal, G S Singhvi and Aftab Alam also said that the lower judiciary had decayed.
"The courts of magistrate and munsif have ceased to be an option for the common man," the Bench said and compared the lower courts to ill-equipped and ill-staffed public health centres (PHCs) in rural areas.
"Only those people go there who have no other option," said the Bench as an apparent indicator of the low measure of public faith in these courts, which are the first points of dispute settlement for the masses.
The comment, perhaps the sharpest-ever from the apex court on the health of the country's judicial administration system.......

Hyderabad: In a major embarrassment for the judiciary, five judges from Andhra Pradesh were caught copying at a Master of Law examination. One of the judges was found copying from a law book hidden under his answer sheet. Written slips and pages torn from textbooks were seized from other judges.

GHAZIABAD: The Central Bureau of Investigation has named six judges among 78 people in an investigative report for fraudulent withdrawal to the tune of Rs 6.5 crore from the provident fund here.
