Mesne Profit

One of my close relative paid rent till september 2007 by cheque for a non residential building occupied by him and the same has been realised by the muslim jamaath committee. The last quarter cheque was rejected by them, though the cheque was sent by regd post .The same was proved in court. Now the muslim jamaath committee  has secured a decree against him for the suit instituted by them for force evacuation of non residential premises. The court has directed him to pay mesne profits of the scheduled premises @ Rs.650/- from nov 2007(Rent unrealised by the committee from oct 2007).

Now my query to the forum is

1)whether the tenant is liable to pay mesne profit alone?

2) or rent too should be added with mesne profit while handing over the possession?

My advance million thanks to those noble hearted luminaries who guide me.

Regards,

k.v.kamath.

Mesne profit are sort of damages for occupation of the premises which becomes unauthorised after the lease is terminated. therefore no rent in addition to mesne profit is payable.
