Hi,


We are planning to start an online business that sells products to customers in US. We plan to receive the order and payment from the customer online and send the product to the customer through courier. In this case, should we send the product as a gift/sample or as a commercial product which might attract customs?

As you are into business doing at market with US people the customers in US attracts customs duty. They have to get clearance from Customs Authority in US

The product we plan to send send usually weigh less than 5 kg and their monetary value will be less than 3000. Do they attract customs even then?

Yes. They will be mostly garments or artificial jewellery.

You need to take care of FEMA circular regarding export of goods. please see the relevent fema Circular in this regard.

Regarding export of goods through Courier etc., please see the relevent information in the below link, which might be useful for your purpose. The value of consignment below Rs. 25000/- seems to be okay, for foreign currency transcation. please see the details in the link.

Yes I saw the limits to send the courier but my question is if it is to be sent as a gift/commercial good through courier.

If  the Courier like TNT/FEDEX accepts the goods as a Gift its no problems. But before accepting courier the TNT or Fedex ask us to show the consignment opened then the goods can be easily appeared. No problems if they accepts the goods as a Gift which is not having any commercial value.
