Property division

Sir, We have six brothers. Out of six, three are living in Agra and rest three are in Delhi. My father left two houses Agra in the year 2009. Till now we could not reach at concensus of division of property i.e. both houses.  Now we all have agreed to sale one house and other one  house shall be occupied by two brothers living at Agra  on differential payment to others who do'nt have their own house.  We four brothers have their own house made out of their sole income.  One at Agra and three in Delhi.  We have taken written agreement of three borthers  on plain paper whom we suspect to withdraw their intention to sell the house. Can this house at Agra be sold if any one of  brothers, who have given written consent to sell the house, does not agree to sell the house? What is the remedy to selling this house. Please advise.

Dear O.P. Shakya,

This is Advocate Rohit Dalmia from Mumbai. if any of the siblings want partition in the faily property, then it is irrelevant whether the other sibling is opposing the same. you can file partition suit for partition of the family property. otherwise, the said siblings could be asked to pay your share in the said property and take the paroperty in his/her name.
