Can deleted email accounts be recovered by court's order?

I have deleted my gmail account in which i had emails sent and received from my boy friend after marriage. My husband had taken copies of them before deleting the account and now threatening me with it. he seeks divorce by court of law. can the deleted account be recovered by court's order? how can i overcome this in the court? can he proove them in the court?

Yes.Deleted datas can be retrieved .He can prove it if court summon to the service provider.But many other factors are to be proved like IP address etc.

Its not clear, do you have a boyfriend after marriage?

When you like your boy friend, accept the divorce from your husband and thereafter live your life happily. Dont get into complications and create a monster out of your husband. what you did is cheating, so deal him with emapthy.

Incase this boyfriend thing is prior to your marriage, then have a plain talk and make him understand how much you love your husband. Give him some space and time. Also, dont accept his divorce. It would be stupid of him to take the legal route with such kind of proofs.

Yes, if you still have affair with the boyfriend then accept the divorce and marry boyfriend.If you are not willing to divorce then it is very unfair that you did with your husband.Choose any one.How old is your marriage?Any kid from hubby?

Better offer your husband divorce through mutual consent. You have been caught between the legs. He will never trust you. And in case you dare to file any false case and if he happen to prove your exta-marital affair then you will be in trouble.

Your husband may file adultery case against your boyfrind to throw you in deep sh*t.

So better go for MCD.

I have a kid,,one year old. I apologised for what I had done to my husband. I did not have any physical relationship with my ex-boy friend. Its not adultery. I just had shared few my troubles and love messages to him when my husband continuously avoided me and tortured so much for dowry. I had chat with him only one week and got caught by my husband who had been checking my emails without my  knowledge like he hacked my password. My husband wants to marry another girl. so he wants to escape from paying me and my kid maintenance. So he needs MCD. How can i deny the emails? is that possible?

If i trust ur version, than u both need to part ur ways........try MCD with ur husband....live ur life and let him life his life...

There is no pointing of reeling such a relation where u still thinks sharing some love msgs with ex-boyfriend was done to share ur feelings when ur hubby was avoiding u .........Its always adviced and better to keep ur personal family talks/issues within urself and ur husband....

You should seek for MCD and live ur life peacefully afterwards

You are just another who when get caught in adultery is accusing her husband for dowry charge. Do you think judges are fool? Better try to convince her about your mistake or offer her MCD

Your husband can get you in trouble. period.

Dont even think about trial and conviction, thats a long way to go and that is only a source for advocates belly. Its not going to fetch you peace.

He hacked your account.He is guilty of cyber crime.There is a judgement posted here by Tajobsindia where Metro wife was held guilty for hacking husband's email account as it is one's personal matter.

Ranee, If you have read that judgement thoroughly then That girl was found guilty and was charged 100 rs. :-) only. In such cases it is almost next to impossible to prove that they were not sharing the password. Husband can very well say that she left her laptop logged in and he accidently checked her mail account or she herself has shared her password.

to proove hacking through MIM or through software capture, she had to be specialzed and tried certain things already. In cases where password hacking  is very specialised, even judges may find difficult to understand. 

@ Author,

if your husband is smart enough he could have captured it with IP addresses, and will screw using new IT act as evidence. and donot spoil your life with cases, go MCD and request him the welfare of child, and for you, better seek some job and move on with life. If your boyfrined is broad minded ask him to marry you with your kid
