Employer not deducting pf

How many number of employees are there in that organisation ? if the number of employees are 20 and more the organisation should register with EPFO of india.

Hi,

There are more than 20 employees in that organization but only 300 employee are registered in the EPFO. And more than 2000 employee are working in this organization.

Upto Rs. 6,500  it is mandatory and above that it is optional... For better clarifications  contact the nearest PF Commissioner Office.

As per the Act, the member has to contribute at the rate of 10% or 12% of his basic pay, D.A. & retaining allowance if any. In case the member wants to contribute more than this, voluntarily he can do so at any rate he desires. i.e. upto 100% of basic and D.A. But the employer is not bound to contribute at the enhanced rate. Rs.6500/- clause not there now.  It is mandatory for every employer to make his contribution of PF after duly deducting the contribution of employee.

If an employee have salary more than 6500 and Does not want to contribute to PF then it is allow.

PF is a stautory benefit provided to an employee. If the company has more than 20 employees and the employee is in the pay roll, then the deduction has to happen and the employee has no choice but to contribute.

above 6500 PF is not mandatory for employer.  it is not choice of emeployee rather of employer.

employee can opt out of pF if he does not want to if his pay band is more than 6500
