Acquittal of hubby, in-laws upheld in dowry-rape case

"The prosecution's evidence is absolutely silent about the delay... caused in lodging of the FIR," said the judges, adding, "The prosecution has failed to prove the offence (of rape)." Seema's allegation that her husband and in-laws constantly demanded money from her parents. Seema claimed her father and brother had paid over Rs 25,000. The HC went through the complaint but found that the allegations were vague and the statements of her father and brothers were inconsistent. "They are unable to state when the demand was exactly made and when they fulfilled the same. It appears that their evidence is absolutely vague as far as the demand of amount and its fulfillment is concerned," the court observed. 


About her allegations that her sisters-in-law used to taunt her for being childless, the HC said there were no specific details on when it had happened. "It is difficult to accept the complainant's version that all (three of) her sisters-in-law at the same point of time had uttered the said utterance thereby causing mental cruelty to her," the HC said.
