Registered power of attorney

IN 2001 MY FATHER RECIEVED A  REGISTERED POWER OF ATTORNEY FROM MY UNCLE AND ALSO MADE A SALE DEED (IN NORMAL STAMP PAPER) WITH FULL DETAILS OF BANK TRANSACTION AND POSSESION .

NOTE: POWER OF ATTORNEY WAS NEVER CANCELLED

NOW, MY FATHER MADE A SALE  AGREEMENT ( IN NORMAL STAMP PAPER)  WITH ME IN 2014 WITH A DETAIL MENTION THAT I WILL START REGISTERING THE LAND FROM 2017  AND WILL PAY MONEY EVERY YEAR IN A FIXED AMOUNT UNTIL WHOLE LAND IS REGISTERED

ON APRIL 2015 MY UNCLE DIED. NOW ACCORDING TO MY INFORMATION POA DISSOLVES AS SOON AN ATTORNEY DIES.

I HAVE SOME QUESTIONS?

CAN I STILL REGISTER THE LAND ON MY NAME ?

CAN HIS  LEGAL HEIRS CLAIM THE PROPERTY?

IS THEIR ANY WAY WEAK POINT IN MY CASE THAT CAN STILL BE MADE STRONG?

CAN A 2014  SALE DEED BETWEEN ME AND MY FATHER  STILL BE MADE REGISTERED?

 

NOTE: MY TERMS WITH UNCLE'S LEGAL HIRES ARE NOT GOOD,THEY ALL ARE GREEDY PEOPLE. 

KINDLY SUGGEST ME THE BEST POSSIBLE WAY I CAN SOLVE THIS.

you can get it done by executing a sale deed as the poa stands invalid now

Hi,

The facts of the case are not clear.

What is sale deed /agreement in normal stamp paper? whether it is registered or not?

What is I ll start registering the land from 2017?

If the POA is registered.. then what was the specific purpose it was executed for?

If you are thinking of executing a registered sale deed on the basis of that POA and unregistered agreement to sale.. it is not valid.

THANKS FOR ALL OF OF YOURS VALUABLE SUGGESTIONS

-- SALE DEED WAS MADE ON NON JUDICIAL STAMP PAPER BETWEEN MY UNCLE AND MY FATHER WITH ALL THE DETAILS OF TRANSACTION AND POSSESSION

-  IN POA it is mentioned that my father has full rights to sell it on behalf of my uncle ,get it registered on any name and take money on his behalf and present in all the government related works.

- IN PART 2 ON SALE DEED OF AAGRICULTURE LAND  BETWEEN MY FATHER  AND ME, I FORGOT TO MENTION THAT ON 3RD APRIL 2015, I AND MY FATHER ON A NON JUDICIAL STAMP PAPER MADE AN AGREEMENT OF SALE AND MENTIONED IN IT THAT I PAID A SMALL BOOKING AMOUNT AND I WILL REGISTER IN PARTS EVERY YEAR AND GET IR REGISTERED ON MY NAME BEFORE 2026, AS I DONT HAVE ENOUGH FUNDS ON BOOKS
