Gratuity act 1972 calarification

I have joined an organisation on 12th july 2011 and left the organisation on 22nd Aug 2015 as i have completed four years is it mandatory for employer to pay my gratuity ? as i have not completed 5 years ?

Not mandatory and intact you are not eligible to claim gratuity.

So: NO as per Payment of Gratuity Act, 1972; 2A

It is vaguely remembered that there were publications that some employers in IT sector offered Gratuity even after 2 years of employment.

The employer can offer and employee can get better terms of Gratuity.

Try by requesting the employer.
