Need suggestion - House owner not returning advance amount

Hi. This is Deepika. I was staying in house for 15 months from June 3rd 2016. Initially agreement was made with 15k rent and 1 lakh advance for 11 months from June 2016 till may 2017. Later we didn't renew the agreement and rent revised to 16.4k Because last time we owned the agreement charges. So expected this time to be renewed by house owner. They demanded that we should stay minimum for year and notice period is 2 months. As per them we stayed for min 1year. We informed them that Hall fan was not working in month of April and requested them to repair. They didn't take any action for almost 4months. So we decided to vacate as there is no proper response from them. Informed him on 2nd September that we are vacating house by this month end. He replied OK. After 4 days he started demanding that if they don't get any tenant within this month end we should stay till 2months. Now we vacated house on 22nd September. He is not ready to repay advance amount until this month end. Also he said he will deduct extra one month rent 16400 for October. Note : They didn't give house for rent with newly painted. His parents were staying and they vacated house without painting it. Also they dumped all their belongings in house itself while vacating. And they didn't inform us about their plan of keeping their belongings. Please advice us. how to approach them to get our money back.

You are liable to give two months notice prior to vacating the premises and if you did not comply with this clause then you are liable to pay rent in lieu thereof.? Landlord has rightly demanded one month rent. Sent notice if he has not pay security amount.

I agree sir that we need to bear 2 months of prior notice as per earlier agreement. we kept on followed up with them to fix fan and tap issues for almost 4 months. House was 10 years old property and we came last year ,felt it not our fault to fix them.But they responded very rude that we need to take care of these issues and they are not ready to bare any of this cost from their end. Due to this reason , we felt like vacating house at the earliest. Are we still liable to pay our one month rent to them? . Please advice
