i gaven suraty of bhai in dhokadadi case in delhi one 2 FD 1 lacs.
now i need the money and ask bhai to give amt gaven surety but he no money.
i spoke to ICICI bank doen FD they ready give me OD of 70% FD.
if i take OD on suraty FD will court catch me..i pay money in 2 manths. lawyer not sure
tell if right

Dear querist,
You can file an application before magistrate to discharge the bond. Section 444 of The Code of Criminal Procedure, 1973 lays down procedure for the same.

nahin file kar sakta bhaiji... i only suraty he bhaisaheb nobody else.
aap batao can i take OD is illegal to take OD on suraty.
