Dear Vijay,

In my view the place (country) where allegedly any cause of action has arisen giving rise to initiation of Arbitral Proceeding shall have the territorial jurisdiction.

In an International Commercial Arbitration, unless the applicable law has been predecided, the parties may agree for applicable law and rules to be applied preferably UNCITRAL Rules.

 

If the parties do not agree for applicable laws, the Indian Party may move under Indian Laws and approach Chief Justice to appoint arbitrator u/s 11(6) of Act.
