Court fees in cheque bounce case

I have received post dated chques for money given to a person. He has paid me 40% of the total amount. If I don' t receive the remaining amount, and want to go legal, how will be my court fees calculated? On the remaining 60% amount or on the whole cheque amount?

Court fees in cheque bounce case punishable under Section 138 of the Negotiable Instruments Act, 1881 is same as that of a criminal complaint, which differs from a State to another such as Punjab, Haryana etc. it is Rs. 10/- whereas Delhi it is Rs. 2/-.

Whereas, court fees in a cheque bounce case suit for recovery under Specific Relief Act is ad-velorum in terms of Court Fees Act, 1870, which again differs from a State to another being a State subject.
