Credit card recovery

Helo Friendss,

 

    Plaintiff is a bank and having its branch in Delhi while the defendant is residing in Chennai.

 

Is it possible that plaintiff can file a suit against defendant who is residing in Chennai.

 

Is there any settled case law on territorial Jurisdiction?

The Debts Recovery Tribunals have been established by the Government of India under an Act of Parliament (Act 51 of 1993) for expeditious adjudication and recovery of debts due to banks and financial institutions.The Chennai Debts Recovery Tribunal was the second such Tribunal to be set up in the Southern Region.

If the transaction took place in Chennai and the terms for jurisdiction is not particular about which place, you may consider for a litigation in Chennai itself.
