Cross examination of defendant/respondent can decree the case?

Sir in the court of Hon'ble Judge Junior Division (lower court) if Respondent is not cross examined (It is advice of Respondent lawyer because age is too much and due to which problem may arose) so on account of this court may give decree judgement. case is Tenant & Landlord; Tenant tenancy period is till date 54 yrs. Tenant has given sufficient amount of proofs to court regarding his properties other than suit property. Tenant not knowing the present plaintiff is derivative landlord & on the basis of known landlord tenant has send MO to the landlord & it is return back to Tenant by remark of "not claimed". 1)Does case can come under Maharashtra Rent Control Act 1999 under Sec. 15? 2) Does case can come under Transfer of Property Act 1887 under Sec.106? I am Tenant & it is very essential bona fide requirement please give me guidance & very helpful to me Thank you
