Under Crpc Section 125 interim maintenance was awarded by family court, aggrieved by order respondent appealed to high court & got stayed. The stay was not vacated by petitioner for about 9 years, now final maintenance will be finalized by court.
As understand final maintenance is generally awarded from the date of application or award along with arrears, in above case since stay was not vacated for a long time by petitioner, will that
non vacation of stay period will be excluded from calculation of arrears please advise.
It is beyond the reach of this platform to speculate on Court decisions.
