Divorce

is it necessary to file divorce where both parties lived together, firstly at the time we both resided at Delhi but now I shifted to ghazaibad can I file divorce from ghazaiabad but my wife didn't stay with me at ghaziabad. she was living away for the last 3 years to some other place .kindly suggest

No you cannot file divorce petition in Ghaziabad court if you both did not last resided together in Ghaziabad. You can file in Delhi court where you both last resided together before she left you and went away 3 years back.

but my lawyer said that I can file divorce from ghaziabad on the basis of rent agreement as I am staying now in ghaziabad . he said withdraw ur case from Delhi and now file it from ghaziabad as I m running my divorce case in Delhi.
