Divorce

 Procedure/ requirements for filing Divorce on the ground that husband has not been

heard of as being alive for a period of seven years or more...

what are the documents to be filed along with the petition for divorce?

You kindly refer the relevant provisions of Hindu Marriage Act or as applicable and state that marriage has not been in subsistence.

1. Proof of marriage, if any - registration certificate/marriage card/marriage photo graph.

2. missing person report to the Police, if available.

3.  In the case, husband's parents and/or his elder brothers have to be called witnesses and they submit the court that they have also not heard about him for the last 7 years.  Then divorce decree will be granted.

Dear madam,

No need to produce any documents to show that the husband is not available for the past 7 years. The averment in the divorce petition itself is enough to esblish the case. If the notice send from the court to the last known address, he may not turned up since he is not available past 7 years. we can get a exparte decree in his absence.

The following documents are necessary to file Divorce by wife:

1. Proof of address to wife to file in the concern jurisdiction. 

2. Marriage invitation/ Marriage certificate

3. Marriage Photo
