Divorce without proof

Page no : 2

Adv Archana Deshmukh (Practicing Advocate)     20 June 2013

@ Aashish ,

From what you say, I feel the facts here are incomplete. There are many nitty gritty involved and should be known before deciding what exactly you need to file to give relief to ur client. I strongly feel you need to interrogate your client further and know some more things before taking any concrete decision as to the filing of divorce petition itself as you may need to file something else instead.   Bcoz remember, one wrong decision or mistake of an advocate at this juncture will drag the client into endless and futile litigations for years. My advice would be not to rush to file a divorce immediately and consult some senior in your bar with complete facts   for the line of interrogation and line of action you need to take in the interest of your client. If it is not possible to obtain guidance then, consult me by email.

@ Adv Archana maam,

i cant thank you enough for your support, i have not yet decided anything as to what i am about to do. i am still contemplating as to how to move forward with the best intentions for my client. but i am curious now, if two people get married in a shady temple, they dont have witnesses (or if one of them does not know them (witnesses), or they are hired!) and since its a run away marriage, one would not take pics or card then what options are there for such a case? i dont know about you maam, but i find it very interesting. off-course to say that this kind of situation is impossible, is something that does not stop me to find a solution. i am more of what if its true kinda guy.

anyways, i have taken too much of your time and thats an unforgivable crime. i am very thankful to all my esteemed colleagues who have given me advice. a special thanks to archana maam, i cant thank you enough maam.

regards

aashish george
