Domestic violence

Hi,

I have been married for 18 years. We had a love marriage.  There were several times fight, disputes, arguments, physical abuse, assault.  These all happens only when he drinks. He is a drunkard.  Usually the fight ends when he says he will not to this next time and there will be blame game and finally compromise.

He is a event organiser with NO BUSINESS.  He doesnt give any money to either run home nor for son's education.  I have a son who is studying in 12th std.

Last saturday, we had a big fight.  He banged my head to the wall and lump has formed.

The next day itself i have sent him out of the house as the rental agreement is in my name and i have paid the rental deposit and monthly rent too..

Now i would not want him to come back and disturb me in office/ home (apartment).

1) Can he claim alimony because i m a working woman but i m taking care of all the HOUSEHOLD EXPENSES INCLUDING SON'S EDUCATION ?

2) I have a built in house (gifted by my parents) too from which i m getting rent, can he ask for a share in property ?

3) when should i file for divorce ?

Dear Querist ,

You have sufficient grounds to file divorce as well as Domestic voilence complaint and yoy can also get protection orders under domestic voilence act and more over you can also file maintenance on behalf of your minor son/children from his father.No he can not claim any right over your property as well as any maintenance from you.Feel free to contact if you left any query in mind.
