A decree passed and one property was attached by sub court and auction sale also conduted. a bidder has taken that property in court auction . same property attached by court,was mortgaged by judgement debtor in bank after attachment by court... the banker shows the same property was mortgaged( it was duly registered) by JD with banker, and the banker shows first one mortgage before the case filed in sub court by decree holder for recovery of money through pronote. but this mortgage was not a regitered one.banker filed a petition to setaside auction sale in sub court
after sometime
now the banker has filed OA In DEBT RECOVERY TRIBUNAL. for recovery of debt from his debtor, and setaside the auction sale by subcourt. now the doubt is after decree passed by civil court, whether tribunal or high court has jurisdiction to question the decree.
