1. If the employee met with an accident during the course of his employment, then the company is liable to pay compensation as well as expenses for medical treatment as per Employees' Compensation Act unless the company is covered under the ESI Act. You cannot avoid your responsibilities. However, if the accident is not arising out of course of employment, then you do not need to pay any compensation but depending on the medical conditons, situations and other supporting medical documents, you have to grant leave to the employee.
2. You are not supposed to ask anyone to resign. Asking Mr.X to resign is like asking Mr.X to commit suicide (this may be a stupid example). If the company is financially suffering due to continuous medical health and absence of such employee, then the company by following due procedure of law can terminate his service, after all company is not doing charity and cannot keep an employee on roll for ever who is unable to work.
