The principle of equal pay for equal work is not essentially included as a fundamental right but it is constitutional goal. It is given under Article 39(d) of the Indian Constitution that says that there is equal pay for equal work for men and women. It is based on the principle of fair pay for both men and women and also provides that they have an equal right and adequate means to livelihood.

In the case of Daily Rated Casual Labour Vs. Union of India, (1998) SCC 122 It was provided that this principle also applies to workers that work on daily wages, just like any other permanent employee. 
Though it is a distant dream to have complete enforcement in the unorganized sector, The Code of Wages Bill, 2019 is seeking to solidify these concerns and providing a basic minimum wage for all alike.
