Eviction of tenant

i am a businessman and own a business.i have a shop which is rented from last 15 years .i want to evict the tenants.i also have other vacant and rented shops on my ame .i want to evict them to due to my son wants to open a bussiness.is it possible to evict tenants.

Sir,

You can evict a tenant, if he becomes a defaulter in paying of rent under Rent control Act.

There are some more ways to evict a tenant as follows:

1. If the tenant made any structural changes to the shop without owners consent;

2. If he started to carry on illegal or immoral business in the shop;

3. if there is an agreement of tenancy and wherein eviction or termination of tenancy clause exists then according to that clause the tenancy can be terminated.

However to put more light on your querry, i need a detailed story.

Initially don't go to court. It'll take 10 to 15 years to solve or even less chance to solve. Convince them by paying little money to them. or inform them you're going to demolish the building due to age o f building or condition of building.

Hi,

I have a commercial premises on rent from last 60 years.

The landlord last issued a rent receipt 20 years ago, after that he stopped taking rent. We have been continuosly after him to sell the property to us, but he is always evading on one pretext or other. The rent is a mere 50/- p.m. He is a big landlord and had almost a hundred proprties bequethed to him by his grandfather. He is one of the biggest landlords of delhi from pre-independence days.

He does not have a son, is retired and has 2 daughters , both married/ doing jobs and settled outside Delhi. The rent receipt is in my partynership firms name, the electricity bill however carries my great grandfather's name ( As the firm's name also starts with his name. Firms name is -Ram Kumar Suresh Kumar, The bill says only Ram Kumar, however since it is a godown, and mostly locked, the bill also has my shops address on it for delivery. I stated this factor as it might have an impact on the whole situation.

Now my query is - Can he evict us , and on which grounds.

what if he sells it to somebody else, will he qualify for bona fide need eviction suit.

my grandfather rented the shop to the tenants more than a 15 years ago.but now i have 2 sons .i want one of my son to do his own bussiness on that shop.but i have one more empty shop which is not suitable for business.is it possible to evict them.
