Ex parte

Hello All,

I am separated from my husband for last 3 years and he filed a divorce case 2 years ago which I am contesting. Since then, I have moved to London and my advocate is fighting the case on my behalf. I know that divorce is inevitable and feel that I want to get it easily now (without going to India). Is it possible? How can I do that without going to India? My advocate is telling me that only option is that I come to India and get the mutual divorce which will take around 6 months. Any suggestions?

for mcd the presence of both the parties is a must and your advocate is right

You need not to contest divorce case, give affidavit in court that you are ready for divorce.

How can I get divorce without going to India. If I ask my advocate to withdraw; will it be ex-parte now?

There are certain recent cases where courts have allowed parties to be present through Skype. Check them out. You can give GPA to your parents and attend proceedings through Skype.
